🇬🇧 Terms & Conditions – Giftphoria

1. General Provisions

These Terms and Conditions (hereinafter “T&Cs”) govern the rights and obligations between Emerald Pin s. r. o. and Emerald Pin Ltd (hereinafter jointly “Seller”) and the customer (hereinafter “Buyer”) when purchasing goods through the online shop www.giftphoria.eu (hereinafter “Shop”).

By placing an order, the Buyer confirms that they have read, understood, and accepted these T&Cs.

3. Definitions

Buyer: A natural or legal person placing an order through the online shop.
Goods: Gift boxes, gift sets, and related products offered in the Shop.

4. Orders and Contract Formation

  1. The presentation of goods in the online shop is not a legally binding offer but an invitation to place an order.
  2. By submitting an order, the Buyer makes a binding offer to conclude a purchase contract.
  3. The purchase contract is concluded only upon written order confirmation by the Seller via email.
  4. The Seller reserves the right to reject orders for objective reasons, including non-availability of goods or suspicion of misuse.

5. Prices and Payment

  1. All prices are in Euros (€) and include statutory VAT.
  2. Any additional shipping costs are clearly displayed before order completion.
  3. Payment is made via bank transfer or the online payment methods offered in the Shop.

6. Delivery

  1. Delivery is made to Germany, Austria, France, UK, Belgium, and the Netherlands. Standard delivery time is 2–5 business days after payment unless a different shipping method is chosen at checkout.
  2. If the Buyer selects express shipping, delivery time is reduced according to the checkout option.
  3. For prepayment, the delivery period starts upon receipt of payment.
  4. If delays occur outside the Seller’s control (e.g., courier issues, force majeure), the Buyer will be informed immediately.

7. Warranty and Liability

  1. Statutory warranty rights under EU law and applicable national law apply.
  2. The Buyer must inspect the goods immediately upon receipt and report visible defects within 14 days.
  3. Complaints should be sent via email to info@giftphoria.eu.

8. Withdrawal, Complaints, and Cancellation

  1. The statutory right of withdrawal does not apply to:
    • perishable goods
    • personalized or custom-made products
    • sealed goods (e.g., food, cosmetics) once the seal is removed
  2. For damaged or incorrect deliveries, the Buyer must report the issue within 24 hours of receipt and provide appropriate photos.
  3. After review, the Seller decides on replacement or refund.

9. Data Protection

  1. Personal data is processed in accordance with the EU General Data Protection Regulation (GDPR 2016/679).
  2. Personal data is used solely for order processing, delivery, invoicing, and customer communication.
  3. Data is shared only with contracted service providers (e.g., shipping and payment providers).
  4. The Buyer has the right to access, correct, delete, or restrict processing of their data at any time.
  5. Data protection inquiries can be sent to info@giftphoria.eu.

10. Gift Vouchers

  1. Gift vouchers are valid for 12 months from the date of purchase.
  2. Vouchers are non-refundable, non-transferable, and cannot be exchanged for cash.
  3. Vouchers cannot be combined with other discounts or used to purchase additional vouchers.

11. Alternative Dispute Resolution

  1. The EU Commission provides an Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/
  2. The Seller is neither obligated nor willing to participate in dispute resolution before a consumer arbitration board.

12. Final Provisions

  1. These T&Cs are effective from the date of publication on www.giftphoria.eu.
  2. The Seller reserves the right to amend these T&Cs at any time.
  3. EU law applies, and where applicable, the law of Germany. The UN Sales Convention (CISG) is excluded.
